This Terms of Service and Individual License Agreement ("Agreement") is a legally binding contract between WBY4, Inc ("Company," "we," "us," or "our") and the individual who creates an account on build-nc.org ("you" or "User"). By completing registration, you represent that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and accept all terms set forth herein.
build-nc.org (the "Site") provides registered users access to the NC Residential Development Process Chart (the "Chart") — a visual reference document depicting the typical sequence of phases, approvals, and activities involved in residential land development in North Carolina, including property evaluation, entitlements, civil engineering, permitting, infrastructure construction, vertical construction, inspections, home sales, and community closeout.
The Chart is provided as a free educational reference. No fee is charged for access.
Subject to the terms of this Agreement, WBY4, Inc grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable personal license to:
This license is granted solely to you as the registered individual. It does not extend to your employer, firm, clients, partners, or any third party. All rights not expressly granted herein are reserved by WBY4, Inc.

By registering, you represent and warrant that you meet the eligibility criteria. WBY4, Inc reserves the right to verify eligibility and revoke access at any time, without notice or obligation.
You may not, under any circumstances:
The Chart, all content on build-nc.org, all associated graphics, text, design, code, and branding are the exclusive intellectual property of WBY4, Inc and are protected under United States copyright law and applicable international treaties. No ownership interest is transferred to you under this Agreement. Your serial number is tied to your individual license and does not convey any property right.
You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. You agree to provide accurate, current, and complete registration information and to update that information if it changes. You must notify us immediately if you suspect unauthorized access to your account. WBY4, Inc is not liable for any loss or damage arising from unauthorized account use resulting from your failure to safeguard your credentials.
The Chart and all content on build-nc.org are provided for educational and general reference purposes only. Nothing on this Site constitutes legal, financial, engineering, planning, architectural, or any other form of professional advice. Every development project is unique and subject to local, state, and federal regulations that vary by jurisdiction and change over time. You should always consult qualified, licensed professionals before making any development, investment, or regulatory decision. WBY4, Inc expressly disclaims liability for any decision made in reliance on the Chart.
The Site and the Chart are provided "as is" and "as available" without warranty of any kind, express or implied. WBY4, Inc makes no warranty that the Chart is complete, accurate, current, or fit for any particular purpose. Regulatory processes, approval timelines, and municipal requirements vary by jurisdiction and are subject to change without notice. To the fullest extent permitted by applicable law, WBY4, Inc disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, WBY4, Inc, its officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind arising out of or related to your use of, or inability to use, the Site or the Chart — including but not limited to loss of profits, loss of data, business interruption, or personal injury — even if advised of the possibility of such damages.
Because the Chart is provided at no charge, our total aggregate liability to you under this Agreement shall not exceed zero dollars ($0.00).
You agree to indemnify, defend, and hold harmless WBY4, Inc and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your use of the Site or Chart; (b) your violation of any provision of this Agreement; (c) your misrepresentation of eligibility; or (d) your infringement of any intellectual property or other right of any person or entity.
By registering, you consent to the collection of your name, email address, company name, ZIP code, and profession for the sole purposes of verifying eligibility, managing your account, and administering the referral program. We do not sell your personal information to third parties. We may contact you via email regarding your account, material changes to this Agreement, or updates to the Chart. We may also contact you with periodic newsletters, platform announcements, industry updates, and other communications we believe may be of interest to you as a registered user. You may opt out of non-essential communications at any time by contacting us at build-nc.org.
WBY4, Inc may suspend or permanently terminate your account and license at any time, with or without notice, for any reason including but not limited to: violation of this Agreement, misrepresentation of eligibility, or any use that poses a risk to the integrity of the Site or the rights of WBY4, Inc. Upon termination, your license is immediately revoked and you must delete all downloaded copies of the Chart in your possession. Sections 6, 8, 9, 10, 11, 14, and 15 survive termination.
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to this Agreement shall first be submitted to good-faith written negotiation for a period of thirty (30) days. If unresolved, disputes shall be settled by binding arbitration in Guilford County, North Carolina, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against WBY4, Inc.
WBY4, Inc reserves the right to modify this Agreement at any time. We will make reasonable efforts to notify registered users of material changes via email to the address on file. Your continued use of the Site after the effective date of any revised Agreement constitutes your acceptance of the new terms. If you do not agree to revised terms, you must discontinue use and request account deletion.
This Agreement constitutes the entire agreement between you and WBY4, Inc with respect to the subject matter herein and supersedes all prior or contemporaneous communications, whether oral or written. If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term. This Agreement may not be assigned by you without the prior written consent of WBY4, Inc.
